eFIXBLACK Terms of Service

These Terms of Service govern access to and use of eFIXBLACK websites, customer and provider accounts, service listings, booking and order tools, communications, payment-related features, support, and other marketplace services. By accessing the platform, creating an account, publishing a service, requesting or purchasing a service, or accepting an order, you agree to these Terms.
1. Company Information

2. The eFIXBLACK Marketplace
eFIXBLACK provides technology that helps customers discover, compare, request, book, communicate with, and review independent service providers. Unless eFIXBLACK expressly states otherwise for a specific offering, eFIXBLACK does not perform the listed services and is not the employer, employee, agent, partner, or joint venturer of any provider or customer.
The service contract is formed directly between the customer and the selected provider. Each provider is responsible for deciding how to perform the service and for the quality, safety, legality, licensing, insurance, taxes, tools, personnel, timing, and completion of that service. eFIXBLACK may facilitate platform functions, payments, support, or disputes, but does not guarantee that a customer will hire a provider, that a provider will receive work, or that a service will meet every expectation.
3. Eligibility
Users must be at least 18 years old, or the age of legal majority in their jurisdiction, and legally able to enter into binding contracts. A person using eFIXBLACK for a company or other entity confirms that they have authority to bind that entity. Users may not access the platform if prohibited by applicable law.
4. Accounts and Verification
Users must provide accurate, current, and complete information and keep it updated. eFIXBLACK may require email, telephone, identity, business, payment, professional, or other verification where appropriate. Verification is a risk-control measure and is not an endorsement, certification, guarantee of skill, or guarantee of conduct.
Users are responsible for protecting login credentials and for activity under their accounts. An account may not be sold, transferred, shared to evade restrictions, or used to impersonate another person. Suspected unauthorized access must be reported promptly.
5. Provider Responsibilities
Providers must:
- Publish accurate descriptions, prices, availability, qualifications, service areas, and material conditions.
- Hold all licences, registrations, permits, insurance, training, equipment, and legal authorizations required for the services they offer.
- Perform accepted services professionally, safely, lawfully, and according to the agreement with the customer.
- Protect customer information and use it only to arrange and perform the relevant service.
- Issue any legally required invoices or tax documentation and meet their own tax, employment, and business obligations.
- Not offer prohibited, unsafe, deceptive, infringing, or unlawful services.
6. Customer Responsibilities
Customers must provide accurate service requirements, location details, access information, and other facts needed by the provider. Customers are responsible for reviewing a provider's profile, scope, price, availability, qualifications, and applicable terms before confirming an order. Customers must provide a reasonably safe and lawful environment for on-site work and pay valid charges for accepted services.
7. Listings, Requests, and Orders
A listing is an invitation to request or book a service and may be changed or removed. An order becomes binding between the customer and provider when accepted or confirmed through the applicable checkout or booking flow. The order details, scope, schedule, price, cancellation conditions, and messages recorded through the platform may form part of their agreement.
Users should keep material arrangements in the platform when possible. eFIXBLACK may cancel, restrict, or review an order affected by suspected fraud, payment failure, safety concerns, prohibited activity, obvious pricing errors, or legal requirements.
8. Prices, Fees, Commissions, and Payments
Prices, platform fees, commissions, taxes, and other charges are displayed or communicated through the relevant listing, account, order, or checkout flow. Users are responsible for reviewing the total before confirming. eFIXBLACK may use third-party payment providers and does not generally store complete payment card details.
Providers authorize eFIXBLACK and its payment partners to collect applicable platform commissions or fees and to process permitted adjustments, refunds, chargebacks, or payouts. Payout timing may depend on order status, verification, payment settlement, disputes, reserves, banking systems, and provider rules. Users are responsible for their own taxes, currency conversion costs, banking fees, and legally required reporting.
9. Cancellations, Refunds, and Disputes
Cancellation and refund eligibility depends on the order status, the provider's disclosed conditions, work already performed, costs incurred, payment-provider rules, platform policies displayed during the transaction, and mandatory consumer law. Users should submit cancellation or dispute requests promptly through the available order or support tools.
eFIXBLACK may review platform records, messages, evidence, payment status, and the parties' cooperation. We may facilitate communication or offer an available platform remedy, but we are not required to decide every private dispute between a customer and provider. Nothing in these Terms limits non-waivable consumer rights.
10. Reviews and User Content
Users may submit profiles, listings, images, portfolios, messages, reviews, and other content. They retain ownership of their content but grant eFIXBLACK a worldwide, non-exclusive, royalty-free licence to host, reproduce, format, display, and use it as reasonably necessary to operate, secure, promote, and improve the platform.
Content must be truthful, relevant, lawful, and respectful. Reviews must reflect a genuine experience and may not be purchased, manipulated, retaliatory, defamatory, or used for extortion. eFIXBLACK may remove or restrict content that violates these Terms, infringes rights, creates safety or legal risk, or undermines marketplace integrity.
11. Prohibited Conduct
Users must not:
- Break any law, licensing rule, sanction, court order, or third-party right.
- Commit fraud, impersonation, harassment, discrimination, abuse, threats, exploitation, or unsafe conduct.
- Publish false, misleading, copied, illegal, or infringing services or content.
- Manipulate prices, orders, ratings, reviews, referrals, promotions, payments, or account verification.
- Send spam, malware, or unauthorized advertising, or collect user information without a lawful purpose.
- Attempt unauthorized access, scraping, reverse engineering, interference, or circumvention of platform security or fees.
- Use eFIXBLACK to arrange prohibited goods, regulated services without authorization, or activity that creates unreasonable risk.
12. Safety and Provider Selection
Users must exercise reasonable judgment when interacting online or in person. eFIXBLACK may offer verification, moderation, reviews, support, or safety tools, but cannot guarantee a user's identity, background, qualifications, insurance, behaviour, or service outcome. Customers should request and independently verify any licence, insurance, certification, or suitability important to the service.
13. Communications
Users agree to receive essential emails, messages, telephone communications, or notifications relating to verification, security, orders, payments, disputes, support, and changes affecting their accounts. Marketing communications are sent only as permitted by law and may be disabled through the available opt-out method.
14. Intellectual Property
The eFIXBLACK name, platform design, software, source code, databases, graphics, text, and other materials supplied by eFIXBLACK are protected by intellectual property laws. Except as permitted by law or expressly authorized, users may not copy, resell, distribute, reverse engineer, modify, or create derivative works from those materials.
15. Third-Party Services
The platform may rely on payment processors, map services, hosting providers, communication tools, identity services, analytics, and other third parties. Those services may have separate terms and privacy notices. eFIXBLACK is not responsible for third-party outages, decisions, content, or conduct beyond its reasonable control.
16. Suspension and Termination
eFIXBLACK may investigate, limit, suspend, or terminate access; remove listings or content; hold or review transactions where legally permitted; or take other reasonable action when it believes there is fraud, abuse, payment risk, unsafe activity, a legal requirement, or a violation of these Terms. Users may stop using the platform and request account deletion, subject to outstanding orders, disputes, balances, and legal retention requirements.
17. Platform Availability and Changes
eFIXBLACK may modify, test, suspend, or discontinue features, categories, fees, or platform availability. We aim to provide a reliable service but do not guarantee uninterrupted, secure, or error-free access. Maintenance, internet failures, third-party systems, security incidents, and events beyond reasonable control may affect availability.
18. Disclaimers
To the extent permitted by law, the platform is provided on an "as available" basis. eFIXBLACK does not warrant the accuracy of every user statement, continuous availability, a particular volume of work, a particular provider, or a particular result. Independent providers, not eFIXBLACK, are responsible for the services they accept and perform. Mandatory legal warranties and consumer rights remain unaffected.
19. Limitation of Liability
To the maximum extent permitted by law, eFIXBLACK and GLOBALIT MODE LTD (company number 16212454) are not liable for indirect, incidental, special, punitive, or consequential losses, loss of profit, loss of opportunity, loss of data, or damage arising from an independent provider's or customer's acts, omissions, services, property, communications, or off-platform arrangements.
Where liability cannot be excluded, total liability arising from a specific marketplace transaction is limited to the amount of platform fees paid to eFIXBLACK for that affected transaction during the preceding six months, unless mandatory law requires a different remedy. This limitation does not exclude liability that cannot legally be excluded.
20. Indemnity
To the extent permitted by law, a user agrees to compensate eFIXBLACK, GLOBALIT MODE LTD (company number 16212454), and their officers, staff, and contractors for third-party claims, losses, and reasonable costs resulting from that user's unlawful conduct, service performance, content, infringement of rights, tax or licensing failure, or material breach of these Terms.
21. Privacy
Personal information is handled according to the eFIXBLACK Privacy Policy. Users should review that policy to understand data collection, use, sharing, retention, international processing, and privacy rights.
22. Changes to These Terms
We may update these Terms to reflect changes to the marketplace, fees, technology, risk controls, or law. The updated version will be posted with a revised date. Where required, material changes will receive additional notice. Continued use after the effective date constitutes acceptance of the updated Terms.
23. Governing Law and Disputes
These Terms are governed by the laws of the United Kingdom, subject to mandatory consumer protections that apply in the user's country. Disputes with eFIXBLACK or GLOBALIT MODE LTD (company number 16212454) are subject to the competent courts of the United Kingdom unless applicable law grants the user another mandatory forum. Disputes concerning the actual service may also involve the independent customer and provider who entered into that service contract.
24. General Provisions
If any provision is found unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver. Users may not transfer their rights or obligations without written consent. eFIXBLACK may transfer these Terms as part of a merger, reorganization, financing, or sale of business. These Terms, the Privacy Policy, and transaction-specific disclosures form the agreement governing use of the platform.
